TERMS AND CONDITIONS
General
These terms and conditions apply to all sales of NF Nutraceuticals BV. The conditions are publicly available and listed on the website of NF Nutraceuticals BV (www.nutri4all.com). This is a translation of the terms and conditions set out in Dutch. In the event of translation errors or contradictory elements, the general conditions established in Dutch prevail.
By placing an order you indicate that you agree with the terms of delivery and payment. NF Nutraceuticals BV reserves the right to change its delivery and/or payment conditions at any time without prior notice.
Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not recognized by NF Nutraceuticals BV.
NF Nutraceuticals BV guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.
Delivery
Delivery takes place while stocks last.
In the context of the rules of distance selling, NF Nutraceuticals BV will execute orders within 30 days. If this is not possible (because the ordered item is out of stock or no longer available), or there is an abnormal delay for any reason, or an order cannot be fully or partially executed, the consumer will receive message after placing the order and in that case he has the right to cancel the order without costs and notice of default.
Barring evidence to the contrary, NF Nutraceuticals BV's delivery obligation will be fulfilled as soon as the merchandise delivered by NF Nutraceuticals BV has been offered to the customer. In the case of home delivery, the carrier's report, including the refusal of acceptance, serves as full proof of the offer for delivery.
Shipping
Orders are generally shipped within 3 business days of receipt of payment. You will receive a tracking number from us with which you can track your package online, as soon as we have handed over your order to the driver.
Deliveries are made on weekdays (excluding public holidays) and between 8 a.m. and 5 p.m. A signature is required to deliver the package. Did the first episode fail? Then the driver will visit you again the next day. After that, the package will be sent to us again and we will contact you for further instructions.
We will send you an email when your shipment has been transferred to the driver. Within the Benelux you will normally receive your order the working day following this email. For other countries within Europe, delivery can take 3 to 7 days.
Shipping costs
Shipments within the Benelux are free of charge for orders above 50 € / are 3.95 € for orders between 25 € and 50 € / 5.95 € for orders under 25 €. The transport costs outside the Benelux differ per country and are shown in your shopping basket. Orders placed separately cannot be combined. Shipping costs will therefore be charged for each order. Mail to info@nutri4all.com for more information about shipping rates or custom shipping to countries not listed. All mentioned periods are indicative.
No rights can therefore be derived from the stated periods.
Prices
Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.
All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.
All prices on the site are in EURO and include VAT.
Payment
Payments are received by Mollie. Payments are accepted via Paypal, iDEAL, Bancontact, Maestro, Visa, Mastercard, online banking from your bank or via bank transfer. A payment by bank transfer takes longer. An order will only be shipped once the correct amount has been transferred to our account.
Trial period / right of withdrawal
In the case of a consumer purchase, in accordance with the Distance Selling Act, the customer has the right to return (part of) the delivered goods within a period of 14 days without giving any reason. This period starts at the moment the ordered merchandise has been delivered. If the customer has not returned the delivered merchandise to NF Nutraceuticals BV after this period, the purchase is a fact. Before proceeding to return the goods, the customer is obliged to report this in writing to NF Nutraceuticals BV within the period of 14 days after delivery. The customer must prove that the delivered merchandise has been returned on time, for example by means of proof of postal delivery. The merchandise must be returned in its original packaging and in new condition (closed seal). If the merchandise has been used, encumbered or damaged in any way at the customer, the right to dissolution within the meaning of this paragraph lapses. With due observance of the provisions of the previous sentence, NF Nutraceuticals BV will ensure that the full purchase price is refunded to the customer within 30 days of receipt of the return shipment. The return of the delivered merchandise is entirely at the expense and risk of the customer.
Guarantee
NF Nutraceuticals BV guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions existing on the date of the conclusion of the agreement. and/or government regulations.
The customer is obliged to immediately check the delivered merchandise upon receipt. If it appears that the delivered merchandise is incorrect, defective or incomplete, the customer (before proceeding to return it to NF Nutraceuticals BV) must report these defects in writing to NF Nutraceuticals BV. Any defects or incorrectly delivered goods must and can be reported to NF Nutraceuticals BV in writing no later than 1 week after delivery. The merchandise must be returned in its original packaging and in new condition. Putting into use after detection of defect, damage caused after detection of defect, encumbrance and/or resale after detection of defect, this right to complain and return expires completely.
If complaints from the customer are found to be well-founded by NF Nutraceuticals BV, NF Nutraceuticals BV will, at its option, either replace the delivered merchandise free of charge or make a written arrangement with the customer about compensation, on the understanding that NF Nutraceuticals BV's liability is always limited is up to a maximum of the invoice amount of the relevant merchandise. Any liability of NF Nutraceuticals BV for any other form of damage is excluded, including additional compensation in any form whatsoever, compensation for indirect damage or consequential damage or damage due to lost profit.
NF Nutraceuticals BV is not liable for damage caused by intent or equivalent deliberate recklessness on the part of the customer.
This warranty does not apply if:
- and as long as the customer is in default towards NF Nutraceuticals BV;
- the delivered merchandise has been exposed to abnormal conditions or otherwise carelessly treated or has been treated contrary to the instructions of NF Nutraceuticals BV and/or instructions for use on the packaging;
- the defect is wholly or partly the result of regulations that the government has set or will set with regard to the nature or quality of the materials used.
Promotional offers
Promotional offers from NF Nutraceuticals BV are only valid when and for as long as they are offered on the website and while stocks last. They do not apply to follow-up and/or repeat orders.
NF Nutraceuticals BV cannot be held responsible for its promotional offer if the customer would understand that the promotional offer, or any part thereof, contained a mistake or typing error.
Oral commitments only bind NF Nutraceuticals BV after they have been expressly confirmed in writing.
Additions, changes and/or further agreements are only valid if agreed in writing.
Agreement
An agreement between NF Nutraceuticals BV and a customer is concluded after an order has been accepted by NF Nutraceuticals BV.
NF Nutraceuticals BV reserves the right, without stating reasons, not to accept orders or to accept them only under the condition that the shipment is made cash on delivery or after payment in advance.
Force majeur
NF Nutraceuticals BV is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.
Force majeure is understood to mean any strange cause, as well as any circumstance, which should not reasonably be at its risk. Delays in or non-performance by our suppliers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in supply, negligence by suppliers and/or or manufacturers of NF Nutraceuticals BV as well as auxiliary persons, illness of personnel, defects in aids or means of transport are expressly regarded as force majeure.
In the event of force majeure, NF Nutraceuticals BV reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that execution remains possible. Under no circumstances is NF Nutraceuticals BV obliged to pay any fine or compensation.
If NF Nutraceuticals BV has already partially fulfilled its obligations upon the commencement of the force majeure, or can only partially fulfill its obligations, it is entitled to invoice the already delivered or the deliverable part separately and the customer is obliged to pay this invoice as if it concerned it is a separate contract. However, this does not apply if the already delivered or deliverable part has no independent value.
Retention of title
Ownership of all merchandise sold and delivered by NF Nutraceuticals BV to the customer remains with NF Nutraceuticals BV as long as the customer has not settled the claims of NF Nutraceuticals BV under the agreement or earlier or later similar agreements and as long as the customer has not paid the claims of NF Nutraceuticals BV has not yet paid due to failure to comply with such obligations, including claims in respect of fines, interest and costs.
The merchandise delivered by NF Nutraceuticals BV that falls under the retention of title may only be resold within the framework of normal business operations and may never be used as a means of payment.
The customer is not authorized to pledge or encumber in any other way the merchandise subject to retention of title.
The customer already now gives unconditional and irrevocable permission to NF Nutraceuticals BV or a third party to be appointed by NF Nutraceuticals BV to enter all those places where its property will be located in all cases in which NF Nutraceuticals BV wishes to exercise its property rights and to take the merchandise there.
If third parties seize the merchandise delivered under retention of title or wish to establish or enforce rights thereon, the customer is obliged to inform NF Nutraceuticals BV of this as soon as may reasonably be expected.
Intellectual property
The texts, page references, illustrations, photos, data sheets and other illustrative elements on the website www.nutri4all.com are protected by copyright and generally by the principles of intellectual property law. The contents of the site www.nutri4all.com may not be copied. Nothing may be changed, nothing may be placed on another site, nothing may be published in any form without prior written permission from NF Nutraceuticals BV. This site may also contain texts, illustrations and other elements that are protected by the copyrights of third parties. NF Nutraceuticals BV does not give permission in any way or under any circumstances to use its intellectual property or that of third parties.
Applicable law/competent court
Dutch law applies to all agreements. Disputes arising from an agreement between NF Nutraceuticals BV and the buyer, which cannot be resolved by mutual agreement, will be heard by the competent court within the district of Maastricht, unless NF Nutraceuticals BV prefers to submit the difference to the competent court of the domicile of the buyer, and with the exception of those disputes that fall within the competence of the subdistrict court.
